Please see below the Terms and Conditions when purchasing from caitlinmacniel.com. By using this website or purchasing from this website you hereby agree to the binding terms as set forth below, known as the “AGREEMENT”. Any parties accessing, purchasing and/or utilising products from this website shall be known as the “CUSTOMER”. Any references to Caitlin and/or caitlinmacneil.com will also be referred to as “we,” “us”, “our”.

1. Products & Artwork

  • Originals & Handcrafted Items: Because original artwork, prints, and handmade goods are unique, slight variations in texture, color, and finish are inherent to the creative process. Colors may also vary depending on monitor calibrations.

  • Sizing & Descriptions: We attempt to be as accurate as possible with measurements and product descriptions, but we do not warrant that product descriptions or other content are entirely error-free.

  • Availability & Pricing: All products are subject to availability. We reserve the right to limit sales, modify prices, or discontinue items at any time without prior notice.

2. Made-to-Order & Custom Commissions

  • Fulfillment Estimates: Estimated creation and lead times stated in product listings or commission agreements are strictly advisory. While we make every effort to fulfill orders promptly, production times are not strictly guaranteed.

  • Cancellations: Orders for custom commissions or made-to-order products cannot be canceled once production or material acquisition has commenced.

3. Payment & Order Refusal

  • Payment Methods: Payments are processed securely via third-party providers (PayPal or Stripe). By purchasing, you agree to provide current, complete, and accurate billing and contact information.

  • Right to Refuse: We reserve the right to refuse or cancel any order at our discretion, including orders suspected of being placed by unauthorized resellers, bots, or fraudulent entities.

4. Shipping, Delivery & Missing Parcels

  • Fulfillment & Risk: Responsibility and risk of loss for physical items transfer to you upon successful delivery confirmation by the shipping carrier to the address provided.

  • Carrier Delays: Delivery timescales provided at checkout are estimates determined by shipping carriers (e.g., USPS, FedEx, Canada Post). We are not liable for transit delays outside our direct control.

  • Missing Items: If an item tracking shows "Delivered" but has not been received, please inspect all entryways and check with household members or neighbors before contacting us within 5 days of the marked delivery date so we may assist in filing a carrier inquiry.

5. Customs, Duties & International Shipping

For orders shipped outside Canada, you are solely responsible for any import taxes, customs duties, or handling fees levied by your local authorities. If an international parcel is returned to us due to unpaid customs fees or refusal of delivery, your refund will be issued minus all incurred shipping, return, and handling fees.

6. Returns & Refunds

  • Return Window: Eligible standard items may be returned within 30 days of receipt for a refund minus original shipping costs. Returned items must be in their original, un-damaged condition.

  • Exempt Items: The following items are non-returnable and non-refundable unless damaged upon arrival:

    • Original paintings and custom works on canvas or paper

    • Made-to-order items

  • Damaged Items: If an item arrives damaged during transit, you must notify us within 48 hours of receipt with clear photographic evidence of the item and external packaging.

7. Intellectual Property & Copyright

  • Ownership: All content on this website—including artwork, designs, photographic images, graphics, and text—is the exclusive intellectual property of Caitlin MacNeil.

  • Usage Rights: Purchase of an original artwork, print, or custom piece transfers physical ownership of the item to you, but does not transfer copyright or reproduction rights. You may not reproduce, scan, resell digital copies of, or commercially exploit any artwork without express written consent from the artist.

8. Limitation of Liability

We are not liable for any injuries, losses, or damages resulting from improper handling, hanging, or care of physical items once delivered to your specified shipping address.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Nova Scotia, Canada, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to update or replace any part of these Terms and Conditions by posting updates to our website. Continued use of or access to our website following any changes constitutes acceptance of those changes.

11. Severability

If any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms.
